REGISTER OF CHARGES
(реестр долговых обязательств,залогов) 1. Список, ведущийся Регистратором компаний, в котором в обязательном порядке регистрируются некоторые долговые обязательства/залоги компаний. Залог возникает в тех случаях, когда компания предоставляет кредитору право на возмещение долга за счет определенных активов. Виды залогов, подлежащих регистрации, а также сведения, которые при этом следует сообщить, установлены Законом о компаниях 1985 г. Нерегистрация залога в течение 21 дня с момента его возникновения лишает соглашение о займе под залог активов юридической силы как для ликвидатора, так и для кредитора компании. Само долговое обязательство не становится от этого недействительным, однако расценивается всего лишь .как необеспеченный долг. 2. Список долговых обязательств, который должен находиться либо по зарегистрированному адресу компании, либо по основному месту ее функционирования. Отсутствие этого списка может повлечь за собой наложение штрафа на компанию и ее руководителей. Список долговых обязательств должен быть доступен для ознакомления в обычное рабочее время компании.
